What Would the Initiative Do?
The 2026 ballot initiative would eliminate anti-discrimination protections for transgender people in public accommodations — the legal framework that has allowed transgender Washingtonians to use facilities that match their gender identity in public spaces including restrooms, locker rooms, schools, and shelters.
These protections were enacted by the Washington State Legislature in 2006 after extensive hearings and public deliberation. They represent nearly two decades of settled civil rights law in Washington State.
Who's Behind It?
The initiative is being funded and organized by out-of-state groups with a national playbook of attacking transgender rights through ballot measures. Similar campaigns have been attempted in other states. In Washington, they are gathering signatures to qualify the initiative for the November 2026 ballot.
What's Actually at Stake
This is not an abstract policy debate. If this initiative passes, transgender Washingtonians would face:
- Loss of the right to use public facilities that match their gender identity
- Increased risk of harassment and discrimination in public spaces
